30名死囚評議簿已銷毀 需提非常上訴恐致羈押空窗期

在死刑釋憲之後，1項重大改變就是判死必須一致決，最高檢也主動審查全台37名死刑犯是否符合條件，能夠提起非常上訴。但今（19）日有立委指出，其中30名死囚的評議簿已經被銷毀，勢必提非常上訴，整個社會要一起收拾和面對。司法院也證實，評議簿依規保留10年，目前保存的尚有7名死刑犯。
